Terms of Service

These Terms of Service ("Terms") are an agreement between you and FoamAgent ("FoamAgent", "we", "us") for use of our website at https://foamagent.app and our app at https://app.foamagent.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a company, you agree on its behalf.

1. The Service

FoamAgent is an estimating assistant for spray foam insulation contractors. It helps you record measurements, calculate areas, board feet, material quantities and costs, and create bids, invoices and calendar bookings.

2. Your account

You must give accurate information and keep access to your account secure. You are responsible for activity under your account. You must be at least 18 years old to use the Service.

3. Subscription, billing and cancellation

• The Service is offered as a paid subscription, currently $49 per month or $490 per year. There is no free plan or free trial.
• Payments are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method at the start of each billing period until you cancel.
• Your subscription renews automatically. You can cancel anytime from the billing settings in the app. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Except where required by law, payments are non-refundable, including for partial billing periods.
• Prices do not include taxes unless stated. We may change prices with advance notice. A price change applies from your next billing period after the notice.
• If a payment fails, we may suspend access until it is resolved.

4. Estimates are your responsibility

The Service calculates figures from the measurements, settings and prices you provide. AI features help interpret what you say and read blueprints, and they can make mistakes. You are responsible for checking measurements, blueprint readings, quantities and prices before you rely on them or send them to a customer. FoamAgent is a tool and does not replace your professional judgment, building codes, manufacturer guidance or on-site inspection.

5. Third-party services

The Service relies on third-party providers, including Stripe (payments), Supabase (data hosting and sign-in), third-party AI model providers (currently Anthropic's Claude, accessed through OpenRouter) and ElevenLabs (voice). Your content may be processed by these providers to deliver the Service, as described in ourPrivacy Policy. We are not responsible for third-party services outside our control.

6. Your content

You own the data you put into the Service, such as jobs, customer details, blueprints and invoices. You give us permission to store and process it only as needed to run and improve the Service. You confirm you have the right to upload it, including any customer information.

7. Acceptable use

You agree not to:

• break the law or infringe anyone's rights using the Service;
• try to access other users' data, or interfere with or overload the Service;
• reverse engineer, resell or share your account outside your business without our permission;
• use the Service to send spam or harmful content.

We may suspend or close accounts that break these Terms.

8. Changes and availability

We may update or change features from time to time. We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. If we make important changes to these Terms, we will let you know in advance.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and accuracy.

10. Limitation of liability

To the extent allowed by law, FoamAgent will not be liable for indirect, incidental, special or consequential damages, or lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

11. Ending the agreement

You can stop using the Service and cancel at any time. We may end or suspend your access if you break these Terms or if we stop offering the Service, with notice where reasonable.

12. Governing law

These Terms are governed by the laws of [State / Country], without regard to conflict-of-law rules.
